1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the DreamCabs website, mobile applications, and shared mobility services (collectively, the "Platform"). By creating an account, booking a ride, registering as a driver, or otherwise using any DreamCabs services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Platform.

2. Definitions

• "DreamCabs", "we", "us", or "our" refers to DreamCabs KMR Pvt. Ltd.
• "Platform" means our website, mobile applications, and related technology services.
• "User" means any person who accesses or uses the Platform, including Passengers and Drivers.
• "Passenger" means a User who books or takes a ride.
• "Driver" means an independent service provider registered on the Platform who offers transportation services.
• "Ride" means a trip booked and fulfilled through the Platform.

3. About DreamCabs

DreamCabs is a technology platform that connects passengers with registered, independent drivers for AI-powered, fixed-route shared mobility. DreamCabs does not provide transportation services itself and is not a transportation carrier.

Drivers are independent service providers and are solely responsible for operating their vehicles in accordance with all applicable laws, regulations, and licensing requirements.

4. Eligibility to Use the Platform

You must be at least 18 years of age and legally capable of entering into a binding contract to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and complete.

5. User Account Registration

To access certain features, you must register for an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. DreamCabs is not liable for any loss arising from your failure to safeguard your account.

6. Passenger Responsibilities

• Provide accurate pickup and drop-off information.
• Be present at the selected pickup point on time.
• Behave respectfully toward drivers and co-passengers.
• Pay all applicable fares and charges promptly.
• Comply with all applicable laws while using the Platform.

7. Driver Responsibilities

• Hold a valid driving licence and all required permits and insurance.
• Maintain the vehicle in safe, roadworthy, and clean condition.
• Operate the vehicle in compliance with all applicable laws and traffic regulations.
• Treat passengers with courtesy and professionalism.
• Provide accurate information during registration and verification.

8. Ride Booking Process

Passengers may book rides by selecting a route and pickup point through the Platform, including via voice booking. Our AI matching engine pairs passengers with available drivers on shared, fixed routes. A booking is confirmed once a matching driver accepts the request.

9. Fixed-Route Shared Mobility

DreamCabs operates a shared, fixed-route model. This means multiple passengers may share the same vehicle along a predefined route. Pickup and drop-off points may be limited to designated taxi stands or stops along the route. Ride times may vary based on the number of shared passengers and route conditions.

10. Fare Estimates, Negotiated Fares & Payments

Fare estimates displayed on the Platform are indicative only. The final fare may vary depending on the route, demand, negotiated pricing, distance, tolls, taxes, waiting time, and other applicable charges.

Payments may be processed through secure third-party payment gateways. DreamCabs does not store your full payment card details. You agree to pay all fares and charges incurred in connection with your use of the Platform.

11. Booking Modifications & Cancellations

You may modify or cancel a booking through the Platform, subject to the applicable cancellation policy. Cancellation charges may apply where a driver has already been dispatched or has arrived at the pickup point.

12. Refund Policy

Refunds, where applicable, are processed to the original payment method within a reasonable period. Refund eligibility depends on the circumstances of the cancellation or service issue and is assessed in accordance with our Refund Policy. Fares for completed rides are generally non-refundable except where required by law.

13. Waiting Time & No-Show Policy

Drivers may wait for a limited grace period at the pickup point. Waiting charges may apply beyond the grace period. If a passenger fails to arrive within the specified time, the booking may be treated as a no-show and cancellation or no-show charges may apply.

14. Driver Verification & Vehicle Requirements

Drivers are subject to a verification process, which may include document checks and background verification. Vehicles must meet minimum safety, insurance, and regulatory requirements. DreamCabs reserves the right to reject or remove any driver or vehicle that does not meet these standards.

15. User Ratings & Reviews

Passengers and drivers may rate and review each other after a ride. Ratings and reviews must be honest and must not contain unlawful, abusive, or misleading content. DreamCabs may use ratings to maintain service quality and may remove users who consistently receive poor ratings or violate these Terms.

16. Safety Guidelines

• Always verify the vehicle and driver details before starting a ride.
• Use in-app safety features such as SOS and trip sharing where available.
• Wear seat belts and follow all safety instructions.
• Report any safety concern to DreamCabs immediately.

17. Prohibited Activities

You agree not to:

• Use the Platform for any unlawful, fraudulent, or abusive purpose.
• Impersonate any person or misrepresent your identity or affiliation.
• Harass, threaten, or harm other users or drivers.
• Interfere with or disrupt the Platform or its security features.
• Attempt to reverse engineer, copy, or misuse any part of the Platform.

18. Intellectual Property Rights

All content, trademarks, logos, software, and technology on the Platform are the property of DreamCabs KMR Pvt. Ltd. or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, or distribute any such material without our prior written consent.

19. Third-Party Services

The Platform may integrate with third-party services such as payment gateways, mapping providers, and communication tools. Your use of such services may be subject to their own terms and policies. DreamCabs is not responsible for the performance, accuracy, or availability of third-party services.

20. Limitation of Liability

To the maximum extent permitted by law, DreamCabs shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. DreamCabs is not liable for delays or failures caused by traffic, weather, road closures, strikes, natural disasters, government actions, or circumstances beyond its reasonable control.

As DreamCabs is a technology platform connecting passengers and independent drivers, it is not responsible for the acts or omissions of drivers or passengers.

21. Indemnification

You agree to indemnify and hold harmless DreamCabs KMR Pvt. Ltd., its officers, employees, and partners from any claims, damages, losses, or expenses arising out of your use of the Platform, your violation of these Terms, or your violation of any applicable law or third-party right.

22. Suspension & Termination of Accounts

DreamCabs may suspend or terminate your account, with or without notice, for fraud, abuse, illegal activities, impersonation, non-payment, or any violation of these Terms. You may also close your account at any time, subject to settlement of any outstanding dues.

23. Data Protection & Privacy Reference

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection and processing of your personal information as described in the Privacy Policy.

24. Force Majeure

DreamCabs shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, war, government restrictions, network or power failures, or pandemics.

25. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

26. Jurisdiction

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Jammu & Kashmir, India.

27. Changes to These Terms

DreamCabs may update or modify these Terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
